Cain Velasquez pleads not guilty to attempted murder and other charges

A former UFC heavyweight champion, Cain Velasquez entered the plea Friday at the Santa Clara County (Calif.) Courtroom in San Jose, Calif. Judge Jessica Delgado presided over the plea hearing.

Velasquez is now scheduled for a preliminary hearing on Sept. 26. An appeal of his denial of bail remains pending in the appellate court.

Velasquez was arrested Feb. 28 after allegedly chasing and firing a gun at a car containing three people, including Harry Goularte, a man accused of sexually assaulting Velasquez’ 4-year-old son. Goularte, who was out on bail after an arrest for “lewd acts with a minor under the age of 14,” was not shot.

However, Goularte’s stepfather, Paul Bender, was hit in the shoulder by a bullet allegedly fired by Velasquez.

That hearing will be held in closed session (in private rooms). Her attorneys and representatives from the Santa Clara County District Attorney’s Office continue to argue over the relevance of documents related to Goularte’s arrest, including interviews with the minor regarding Goularte’s alleged sexual abuse.

On Friday, DA attorney Aaron French argued that only a portion of the Goularte investigation should be included in the Velasquez discovery because it is an ongoing investigation and involves the integrity and privacy of the juvenile.

In addition, Velasquez defense attorneys Alexandra Kazarian and Renee Hessling and French objected to the prosecutor’s plan to not call Goularte as a witness.

“Harry Goularte was fundamental and essential to what he observed and how this investigation against Mr. Cain Velasquez unfolded,” Hessling said.

“To say that he should just be completely excised from this equation and pretend that he doesn’t exist and just completely dismiss his presence or the type of role he has in this, I think that’s a fiction. I don’t think it’s practical. I think it’s fundamentally unfair to Mr. Velasquez”
